Instalment Order

If a debtor is self-employed, their income can't be attached by an Attachment of Earnings Order and an instalment order is used as an alternative, the EJO will consider what appears to be a reasonable amount for them to pay over a period of time either weekly or monthly which is paid directly to the creditor. It is therefore the responsibility of the creditor to keep the office informed of all monies paid or indeed if the debtor defaults in payment. A debtor may be committed to prison for failure to keep up payments due on an Instalment Order. Committal proceedings are costly and taken under separate proceedings, please contact a solicitor for further information.

How do I get an instalment order?

Instalment Orders are only issued upon receipt of a Full Enforcement Application by the EJO.

Is there a fee attached?

There is no additional fee attached, as the fee paid with the Full Enforcement Application covers this.
