Maximum penalty doubles
Currently, the maximum protective award for failing to collectively consult with a trade union, is 90 days' pay per employee.
Since 6 April 2026, this has doubled to 180 days' pay per employee.
The government has also agreed to produce guidance on compliance with collective consultation obligations (for employers) but hasn't given an indication of when it will be available.
