New requirement to consult
Sometime at the end of 2026 (expected in December 2026, but the precise date is yet to be set by the government) employers will be required to:
- Consult about their tips policy with trade union or workers' representatives, or directly with affected staff, before completing a first version of it. The first version of the policy must then be made available to the affected staff.
- Re-consult and review the policy at least once by the first policy's third anniversary, and then again no more than 3 years after the last review.
- Provide an anonymised summary of the views expressed in each consultation.
See the statutory code of practice on distributing tips for the new requirements.
